Terms and Conditions of Genki Membership Program

Genki Sushi Hong Kong Limited ('Genki Sushi') is owned and operated by Maxim’s Caterers Limited. The Genki Membership Program ('Program') is managed and operated by Genki Sushi. An applicant or a Genki member ('Member' or 'Membership') who participates in the Program hereby confirms that he/she agrees to be bound by the terms and conditions set out herein below, (such terms and conditions and they as may be amended by Genki Sushi from time to time at its sole discretion are referred to as the 'Terms').


A. Genki Membership Program and Privileges Overview:

1. There are three (3) levels of the Membership in the Program: Basic Pass, Silver Pass and Premium Pass. The Program is open to (i) selected customers and (ii) the general public upon reaching the entry criteria of a Membership level set out in the table ('Table') below.

Upgrade Criteria:

Upgrade to Premium Pass once Cumulative Spending of HK$16,000 has been reached within the validity period of the current Silver Pass Membership

Renewal Criteria:

Renew for 2 years with Cumulative Spending of HK$800 in the last two months before the expiry of current Silver Pass Membership

Validity period of Genki Point:

Points (as defined below) earned in the 1st year: valid till the 13th month from the start of the current Membership year; Points earned in the 2nd year: valid till the expiration of the current Membership year


Level: Premium Pass

Validity period of Membership:

1 year

Entry Criteria:

Upgraded from Silver Pass

Renewal Criteria:

Renew for 1 year with Cumulative Spending of HK$8,000 within the validity period of the Premium Pass Membership. For Cumulative Spending less than HK$8,000 in such period, the membership will be downgraded to Silver Pass.

Validity period of Genki Point:

Valid till the expiration of the current Membership year

2. By registering according to paragraph B(1) below, eligible applicants will be enrolled to one of the following Membership levels if they fulfil the relevant entry criteria set out in the Table.

3. For the details on Membership Privileges in relation to the Membership level, please refer to the terms and conditions of “Genki Member Privileges” (which may be amended by Genki Sushi from time to time and will form part of these Terms) for details.

4. Genki Sushi has the sole discretion to decide whether an individual is eligible for Membership entry, upgrade and renewal and such decision is final and conclusive.

 

B. Membership Application:

1. Applicant with a single spending (“Spending”) of HK$100 or above at Genki Sushi can apply and register as Basic Pass Member, either by scanning the invitation QR code as shown on the receipt of the Spending; or where applicable, through the invitation link from online ordering of the Spending or in the order confirmation email; while the applicant with a single Spending of HK$950 or above at Genki Sushi can directly register as Silver Pass Member. Membership registration should be submitted to Genki Sushi within 7 days of the relevant eligible Spending.

2. For the purpose of paragraph B(1) above, Spending includes dine-in, takeaway order and online takeaway ordering only, exclusive of spending on third-party takeaway platforms. Spending is calculated after the use of all promotional offers and discounts (if any), plus 10% service charge on the original price.

3. Each valid mobile phone number and email address can be registered for Membership once only. The applicant must register with a correct and valid mobile phone number from Hong Kong. The applicant must be the legitimate owner of the registered mobile phone number. Each person can apply for and hold one Membership only.

4.The applicant must be aged 16 or above. If the applicant is 16 years old or older but under the age of 18 years, he/she shall obtain the consent and authorisation from his/her parent or guardian of these Terms before completing the Membership registration . Applicant must immediately terminate the membership and discontinue its use if his/her parent or guardian does not agree to these Term.

5. In order to apply for Membership, the applicant must complete all mandatory fields in the application form in full and provide true and accurate information. Applicant must verify his/her registered email address within 24 hours after application submission. Genki Sushi will not process any application with incomplete or inaccurate information, and reserves the right to decline any application for Membership at its sole and absolute discretion and without giving any reason therefor.

6. Upon successful verification of the application and information including email address, the applicant will receive a Membership welcome email and be given a Member number once the membership is valid within 24 hours.

 

C. Membership Usage, Upgrade and Renewal:

(I) Usage

1. Member should download Genki Sushi Mobile Application (“Mobile App”) for using Membership services and/or log-in the Member Area at Genki Sushi website to access his/her Member account and review Membership information, including but not limited to the accumulated Genki Points (“Points”), Cumulative Spending (as defined below under paragraph C(I)3) and Membership level update. Mobile App is only available on mobile devices using the latest version of iOS and AOS.

2. Member should only use his or her Member account to login one mobile device simultaneously. The Membership is non-transferrable. Genki Sushi shall be entitled to deem that the user of the Mobile App has the authority to act for the Members in all matters relating to the Program.

3. Once membership is valid, Spending will start to be counted towards the cumulative spending amount in the Membership account (“Cumulative Spending”).

4. Cumulative Spending is calculated based on the eligible Spending after the use of all promotional offers, discounts and before the use of Genki Point (if any), plus 10% service charge on the original price.

5. For the purpose of recording Cumulative Spending in the Member account, Member must present the Member account in person at Genki Sushi outlet upon payment or log-in Member account for online takeaway ordering. The entire transaction can be recorded on one Member account only. Genki Sushi will not accept any claim of missing transaction in any Member account after payment under any circumstances.

6. Cumulative Spending in different Member accounts cannot be combined.

7. Record of Cumulative Spending in a Member account will be updated within 24 hours after the transaction being recorded. Genki Sushi’s record is final and conclusive.

8. If there is any suspicious or irregular activity or transaction relating to Member account, please immediately contact Genki Sushi customer service hotline at 2101-1161 (Monday to Sunday: 10am – 9pm).

9. Member account is not transferable or assignable and is for Member’s personal use and benefit only. Genki Sushi reserves that right to request for verification of Member’s identity.

10. Except where otherwise provided, Member privileges cannot be used in conjunction with other promotional offers, discounts, gift vouchers and purchase of any takeaway container and cutlery.

11. Except as specifically provided for in the Terms, only Silver Pass and Premium Pass Members are entitled to earn Points upon purchasing regular-priced items at Genki Sushi outlets in Hong Kong. Points are calculated based on the total net amount of the transaction. The amount of 10% service charge and purchase amount of any takeaway container and cutlery will not be counted in calculating the Points earned for any transaction. Where the transaction involves the use of any third-party offer, discount or cash coupon, no Points will be awarded for such entire transaction. For the details on earning/accumulating Points in relation to the Membership, please refer to the terms and conditions of “Genki Member Privileges” (which may be amended by Genki Sushi from time to time and will form part of these Terms) for details.

12. Any exercise of Membership rights and any Member-related transactions including but not limited to Member discounts, Points earning, refunds must be made with the presentation of a Member account. If Member account was not presented at the time of payment or Member account was not log-in for online takeaway ordering, in no event shall Points be used or redeemed for that transaction.

13. Points earned will normally be issued and credited to the Member account within 24 hours after the transaction.

14. Points should be used or redeemed before the expiry of the relevant "Validity period of Genki Point” as set out in the Table or in Member Account, and any Point(s) used or redeemed will be deducted from the Member account instantly. All unused Points will be automatically forfeited upon such expiration.

15. Points cannot be sold, purchased, transferred, gifted away, assigned or otherwise to other individual or another Member, and cannot be exchangeable for cash or combined for use with Points in other Member’s account.

16. Points can be checked in the Mobile App and the Member Area. Genki Sushi’s record (including but not limited to the record of Points balance in each Member account) is conclusive and final and binding on Member.

17. For new Members admitted on or after 24 October 2022 or Membership renewed on or after 1 November 2022, the validity period of the Point(s) as set out in the Table shall apply.

18. Genki Sushi reserves the right to withhold Points if Genki Sushi suspects such purpose or Spending to be fraudulent. In such case, Genki Sushi is also entitled to suspend the Membership for assessment until further notice or terminate such Membership.

19. Genki Sushi may, at its sole determination, deduct Points from the Membership account in the following situation:- (i) Any Points suspected to be fraudulently recorded or earned by Member; (ii) Any Points recorded in error; or (iii) Any Points relating to a transaction which has been cancelled and/or refunded.

20. Genki Sushi may from time to time impose requirements and/or limitations on Member’s participation in any promotion. Therefore, Member may not be eligible to participate in all promotions. Member taking part in any promotion shall be deemed to have agreed to be bound by the applicable terms and conditions which may be imposed by Genki Sushi in relation to such promotion.

 

(II) Membership Upgrade, Downgrade and Renewal

21. (a) Basic Pass Members will be upgraded to Silver Pass Members when the Members have accumulated Cumulative Spending of HK$950 or above within any consecutive 62 days during the validity period of such Basic Pass Membership.

(b) Silver Pass Members will be upgraded to Premium Pass Members when the Members have accumulated Cumulative Spending of HK$16,000 or above within the validity period of such Silver Pass Membership.

(c) Premium Pass Members will be downgraded to Silver Pass Members when the Members fail to accumulate Cumulative Spending of HK$8,000 or above within the validity period of such Premium Pass Membership.

22. (a) The Membership upgrade mentioned in paragraph 21(a) and (b) above will be implemented automatically in the next working day upon the Cumulative Spending fulfilling the upgrade criteria within the applicable designated period as set out in the Table.

(b) The Membership downgrade mentioned in paragraph 21(c) above will be implemented automatically at the end of the validity period of the Premium Pass Membership if the Cumulative Spending cannot meet the renewal criteria within the applicable designated period as set out in the Table.

23. Silver Pass and Premium Pass Memberships will be renewed at the end of the applicable validity period of such Membership upon the Cumulative Spending fulfilling the applicable renewal criteria within the applicable validity period of such Membership as set out in the Table.

24. For the newly upgraded level of Membership which is in a level higher than the previous Membership level, the upgraded Membership’s validity period is valid from the commencement of the upgraded Membership until the end of the validity period of such upgraded level of Membership.

25. For renewed Membership in Premium Pass and Silver Pass levels, and/or Membership downgraded from Premium Pass to Silver Pass, the Membership validity period is valid from the commencement of such renewed/downgraded Membership until the end of the validity period of such renewed/downgraded Membership.

26. Member can login to Member’s area via Genki Sushi website or Mobile App to check the expiry date of the current Membership. In order to safeguard the rights and privileges of Members, Genki Sushi will notify Members of the Membership expiry date before expiration of Membership.

27. Membership upgrade and downgrade are automatically handled by the system, based on the amount of Cumulative Spending. Members cannot choose whether to be upgraded or downgraded.

 

(III) Expiry

28. Basic Pass Membership will automatically expire upon the end of the relevant Membership validity period if it fails to meet the upgrade criteria within the designated period during the applicable Membership validity period set out in the Table.

29. Silver Pass Membership will automatically expire upon the end of the relevant Membership validity period if it fails to meet to the applicable renewal criteria within the designated period as set out in the Table.

 

(IV) Termination

30. Member may terminate his/her Membership at any time by informing Genki Sushi in writing. All unused Points will then be forfeited on the termination of the Membership.

31. In the event of any breach of the Terms, Member’s abuse of any of the Program privileges in Genki Sushi’s sole opinion, or the use of the Member account in an unauthorized, fraudulent or otherwise unlawful manner, Genki Sushi reserves the right to terminate or suspend the Membership and/or revoke all the Points that have been earned or accumulated by the Member without notice. Genki Sushi will not be liable for any loss or damage resulting therefrom and also has the right to take action for recovery of any loss and/or damage suffered by Genki Sushi under these circumstances.

32. Genki Sushi reserves the right to terminate the Program and/or its operation at its sole discretion at any time with reasonable notice, without giving any reason therefor. All rights and/or privileges of an applicant/Member shall cease upon termination and Genki Sushi will not be liable for any loss or damages resulting therefrom.

 

D. Member Account and Mobile App

1. Member account stored at the Mobile App is for the sole and exclusive use by the Member. Member shall not allow or knowingly allow any other person to use the Member account (or any related information).

2. Member acknowledges that there may be a time lag in transmission of instructions, information or communication relating to the Program.

3. Member shall act in good faith, exercise reasonable care and diligence in keeping his/her Member account (and its related information).

4. Member shall be fully liable for any accidental or unauthorized disclosures of his or her Member account (and its related information) and shall bear the risks of Member account (and its related information) being used by unauthorized persons or for unauthorized purposes.

5. Upon notice or suspicion of Member account (and its related information) being disclosed to any unauthorized person or for unauthorized purposes, Member should notify Genki Sushi as soon as practicable and, until Genki Sushi’s actual receipt of such notification, Member shall remain liable for any and all use of Member account by unauthorized persons or for unauthorized purposes.

6. None of Genki Sushi or any network provider warrants or represents that the Mobile App, Member account and related information is free from virus or other destructive features which may adversely affect the Member’s devices, including its hardware, software and/or equipment.

 

E. Data Privacy

1. The personal data supplied by Members is required for the operation of the Membership. For details of how Genki Sushi uses the personal data in connection with your Membership, please refer to Genki Sushi’s Privacy Policy Statement (“Privacy Policy”). Failure by Members to provide or keep required data up to date may result in Genki Sushi being unable to provide Membership services and associated benefits. In such cases, Membership may be terminated.

2. All personal data is managed in accordance with the Privacy Policy. Such Privacy Policy is deemed incorporated into and form part of the Terms.

3. Members have the right to exercise their data protection rights such as request to access certain personal data held about them by Genki Sushi and correct any inaccuracies as set out in the Privacy Policy. Members can contact our customer services hotline or follow the contact method as set out in the Privacy Policy to exercise such rights.

4. Members should provide up-to-date contact details, including current email and phone number to ensure that all Program communications are being sent to the proper address. Members should notify Genki Sushi immediately of any change in such contact details. Genki Sushi shall not be liable for any potential or actual loss, claims or damages in any form incurred by the Member arising directly or indirectly from the lack of accurate and up-to-date contact details.

5. Members must ensure that safe keeping of his/her Member number and the password is not disclosed to any unauthorised parties. Genki Sushi cannot be held liable for the consequences of any unauthorised disclosure of the password by Members or unauthorised use of the password.

 

F. Miscellaneous

1. Genki Sushi shall not be liable to any Member for any indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with the Membership and/or the use of or the unavailability of any Membership services and/or the provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by negligence or otherwise, and whether Genki Sushi have any control over the circumstances giving rise to the claim or not.

2. Member has no right to participate in the constitution, operation or management of the Program nor any right in or any claim to any assets of Genki Sushi.

3. In the event of any dispute arising from Member account or Program, Genki Sushi’s sole decision shall be final and binding on an applicant and/or Member.

4. An applicant’s or a Member’s use of the Mobile App and/or Genki Sushi website is deemed to be an acceptance of the Terms. For the Term and Privacy Policy, please visit Genki Sushi website: members.genkisushi.com.hk or Mobile App.

5. Genki Sushi reserves the right to modify the Membership programme, Membership tier, benefits and other features including the Terms or revoke any right and/ or privilege upon reasonable notice, where possible, and Genki Sushi will not be liable for any loss or damage resulting therefrom. All changes or amendments are effective once announced on the Genki Sushi website or Mobile App. Applicant or Member should regularly check whether the Terms have been modified or right and/or privilege has been revoked via Genki Sushi website or Mobile App as an applicant’s or Member’s continued use of Genki Sushi website or Mobile App indicates the acceptance of any change to the Terms and/or revocation of right and/or privilege. In case of any dispute, the decision of Genki Sushi shall be final and conclusive.

6. The failure by Genki Sushi to exercise or enforce any rights herein contained shall not be deemed to be a waiver thereof nor shall it affect Genki Sushi’s entitlement to take any subsequent action in respect of that right or of any other right.

7. Should any provision of these Terms be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

8. These Terms and the relationship between Genki Sushi and each Member and applicant are governed by Hong Kong law. Genki Sushi and each Member and applicant submits to the non-exclusive jurisdiction of the Hong Kong courts.

9. If there is any inconsistency or conflict between the English version and Chinese version of the Terms, the English version shall prevail.

Remarks:

1. Welcome Offer

Basic Pass: A 'Free sashimi upon spending of $250' e-coupon

Silver Pass: A 'Classic Genki Teacup & a pack of Green Tea Powder (50g)' e-coupon, to be redeemed at Hong Kong Genki Sushi outlets

Premium Pass: Two '$50 off upon spending of $250 or above (Only applicable for Dine-in/ Takeaway)' e-coupons and Two '$80 off upon spending of $400 or above (Only applicable for Online)' e-coupons

The above e-coupons will be sent to the Member’s account via Mobile app. Members must login in order to retrieve the relevant e-coupon. The e-coupon will not be re-sent after its expiry date. Please refer to terms and conditions of e-coupon for details.

 

2. Genki Points

(a) Only Silver Pass and Premium Pass Members are eligible to earn and use Genki Points for their dine-in, takeaway transactions at Hong Kong Genki Sushi outlets or online takeaway transactions. Exclusive of spending on third-party takeaway platforms.

(b) Based on the total net amount of the transactions, 1 Genki Point (“Point”) will be earned for every $10 spent during the valid Genki membership period. No Point will be awarded for service charge in the transactions.

(c) Premium Pass Members can earn 1.5X Points during Monday to Thursday (except for Friday, Saturday, Sunday and public holiday).

(d) The spending in cents and transaction under $10 will not be counted in calculating the Point(s) earned for any transaction. For example, if the net transaction amount is $125.50, 12 Points will be earned.

(e) Every 10 Points earned can be used as $10 in the subsequent transaction at Hong Kong Genki Sushi outlets. Points can be used in blocks of 10 Points. Points used will be deducted from the Member account instantly at the transaction.

(f) All cancelled transactions and refunds are not eligible for Points, such Points will be automatically deducted from the Member account, including the extra Points earned from specific promotions.

(g) Points are not transferable to another Member.

(h) For expiry of Points earned from specific promotions, member should refer to the "Expiry Date of Genki Points” in Member Account

 

3. In-app queuing

(a) Silver Pass Members and Premium Pass Members may enjoy in-app queueing service.

(b) Premium Member Express Queuing service is only available via in-app queuing. Express Queuing service is not available at queuing machines at stores.

 

4. Thankful Day Discount

(a) Silver Pass Members may enjoy a 20% off at any Hong Kong Genki Sushi outlets on Genki Member Thankful Day (The first Wednesday of every month, unless specified otherwise) by his/her valid Member account at the time of payment.

(b) Premium Pass Members may enjoy a 20% off at any Hong Kong Genki Sushi outlets on Genki Member Thankful Day (The first Tuesday of every month, unless specified otherwise) by his/her valid Member account at the time of payment.

(c) Please present a valid Member account at Hong Kong Genki Sushi outlets or login with a valid Member account during online takeaway ordering at the time of payment to enjoy the Thankful Day discount.

(d) This offer is only valid at Genki Sushi outlets in Hong Kong. Only applicable for dine-in, takeaway and online takeaway ordering (same-day pickup only). Third-party takeaway platform and Genki Sushi festive takeaway sets are not applicable to this offer.

(e) Additional 10% service charge applies for dine-in, which is calculated from original dine-in total amount before applying the discount.

(f) Points can be used together with the Thankful Day offer, but no Points will be awarded for the whole transaction.

(g) This offer cannot be used in conjunction with Genki Sushi coupons, e-coupons (except yuu Maxim’s voucher), cash coupons, other promotional offers, discount and purchase of any takeaway container and cutlery.


 

5. Birthday Discount

(a) Silver Pass and Premium Pass Members may enjoy a one-time birthday discount at any Genki Sushi outlets in Hong Kong during his/her birthday month (e.g. if the Member’s birthday is on 15 Oct, birthday month covers the period from 1-31 October) by presenting the birthday e-coupon. The birthday discount for Silver Pass Members is a 20% off discount, whereas that of Premium Pass Members is a 25% off discount.

(b) If the Membership is created on his/her birthday month, Member may enjoy the birthday offer in his/her birthday month in the following year. For example, the Member has registered in June which is also his/her birthday month, he/she may enjoy the birthday offer in June in the following year.

 

6. Member price menu, Secret Menu and Discount/Free dish coupon

(a) Member is required to login Member Account with Genki Sushi mobile app, use "Scanner" to scan the ordering QR code to order exclusive menu via dine-in Mobile Order. Alternatively, member may select Member Menu to order exclusive menu via online takeaway ordering platform.

(b) Member is required to login Member Account with Genki Sushi mobile app, use "Scanner" to scan the ordering QR code to order and enjoy exclusive menu discount offer via dine-in Mobile Order. Such offer requires presentation of the same Member Account used for Mobile Order and upon payment. If a different Member Account is presented upon payment or check out as Guest, no member exclusive menu discount offer will be applied. Alternatively, member may select Member Menu to order and enjoy exclusive menu discount offer via online takeaway ordering platform.

(c) Limited Time Surprise Privileges will be launched from time to time . Please refer to the latest announcement of Genki Sushi website or mobile app for details.

 

7. Terms and Conditions of Genki Membership Program

(a) The above privileges and offers are subject to Terms and Conditions of Genki Membership Program. For details, please refer to Genki Sushi website, Mobile App or call 2101-1161 (Monday to Sunday: 10am - 9pm).

(b) Genki Sushi Hong Kong Limited reserves the right to amend the above terms and conditions of the above privileges and offers from time to time without prior notice. In case of any disputes, the decision of Genki Sushi Hong Kong Limited shall be final.

2. By registering according to paragraph B(1) below, eligible applicants will be enrolled to one of the following Membership levels if they fulfil the relevant entry criteria set out in the Table.

3. For the details on Membership Privileges in relation to the Membership level, please refer to the terms and conditions of “Genki Member Privileges” (which may be amended by Genki Sushi from time to time and will form part of these Terms) for details.

4. Genki Sushi has the sole discretion to decide whether an individual is eligible for Membership entry, upgrade and renewal and such decision is final and conclusive.

B. Membership Application:
1. Applicant with a single spending (“Spending”) of HK$100 or above at Genki Sushi can apply and register as Basic Pass Member, either by scanning the invitation QR code as shown on the receipt of the Spending; or where applicable, through the invitation link provided from online ordering of the Spending or in the order confirmation email; while the applicant with a single Spending of HK$950 or above at Genki Sushi can directly register as Silver Pass Member. Membership registration should be submitted to Genki Sushi within 7 days of the relevant eligible Spending.

2. For the purpose of paragraph B(1) above, Spending includes dine-in, takeaway order and online takeaway ordering only, exclusive of spending on third-party takeaway platforms. Spending is calculated after the use of all promotional offers and discounts (if any), plus 10% service charge on the original price.

3. Each valid mobile phone number and email address can be registered for Membership once only. The applicant must register with a correct and valid mobile phone number from Hong Kong. The applicant must be the legitimate owner of the registered mobile phone number. Each person can apply for and hold one Membership only.

4. The applicant must be aged 16 or above. If the applicant is 16 years old or older but under the age of 18 years, he/she shall obtain the consent and authorisation from his/her parent or guardian of these Terms before completing the Membership registration . Applicant must immediately terminate the membership and discontinue its use if his/her parent or guardian does not agree to these Term.

5. In order to apply for Membership, the applicant must complete all mandatory fields in the application form in full and provide true and accurate information. Applicant must verify his/her registered email address within 24 hours after application submission. Genki Sushi will not process any application with incomplete or inaccurate information, and reserves the right to decline any application for Membership at its sole and absolute discretion and without giving any reason therefor.

6. Upon successful verification of the application and information including email address, the applicant will receive a Membership welcome email and be given a Member number once the membership is valid within 24 hours.

C. Membership Usage, Upgrade and Renewal:

(I) Usage

1. Member should download Genki Sushi Mobile Application (“Mobile App”) for using Membership services and/or log-in the Member Area at Genki Sushi website to access his/her Member account and review Membership information, including but not limited to the accumulated Genki Points (“Points”), Cumulative Spending (as defined below under paragraph C(I)3) and Membership level update. Mobile App is only available on mobile devices using the latest version of iOS and AOS.

2. Member should only use his or her Member account to login one mobile device simultaneously. The Membership is non-transferrable. Genki Sushi shall be entitled to deem that the user of the Mobile App has the authority to act for the Members in all matters relating to the Program.

3. Once membership is valid, Spending will start to be counted towards the cumulative spending amount in the Membership account (“Cumulative Spending”).

4. Cumulative Spending is calculated based on the eligible Spending after the use of all promotional offers, discounts and before the use of Genki Point (if any), plus 10% service charge on the original price.

5. For the purpose of recording Cumulative Spending in the Member account, Member must present the Member account in person at Genki Sushi outlet upon payment or log-in Member account for online takeaway ordering. The entire transaction can be recorded on one Member account only. Genki Sushi will not accept any claim of missing transaction in any Member account after payment under any circumstances.

6. Cumulative Spending in different Member accounts cannot be combined.

7. Record of Cumulative Spending in a Member account will be updated within 24 hours after the transaction being recorded. Genki Sushi’s record is final and conclusive.

8. If there is any suspicious or irregular activity or transaction relating to Member account, please immediately contact Genki Sushi customer service hotline at 2101-1161 (Monday to Sunday: 10am – 9pm).

9. Member account is not transferable or assignable and is for Member’s personal use and benefit only. Genki Sushi reserves that right to request for verification of Member’s identity.

10. Except where otherwise provided, Member privileges cannot be used in conjunction with other promotional offers, discounts, gift vouchers and purchase of any takeaway container and cutlery.

11. Except as specifically provided for in the Terms, only Silver Pass and Premium Pass Members are entitled to earn Points upon purchasing regular-priced items at Genki Sushi outlets in Hong Kong. Points are calculated based on the total net amount of the transaction. The amount of 10% service charge and purchase amount of any takeaway container and cutlery will not be counted in calculating the Points earned for any transaction. Where the transaction involves the use of any third-party offer, discount or cash coupon, no Points will be awarded for such entire transaction. For the details on earning/accumulating Points in relation to the Membership, please refer to the terms and conditions of “Genki Member Privileges” (which may be amended by Genki Sushi from time to time and will form part of these Terms) for details.

12. Any exercise of Membership rights and any Member-related transactions including but not limited to Member discounts, Points earning, refunds must be made with the presentation of a Member account. If Member account was not presented at the time of payment or Member account was not log-in for online takeaway ordering, in no event shall Points be used or redeemed for that transaction.

13. Points earned will normally be issued and credited to the Member account within 24 hours after the transaction.

14. Points should be used or redeemed before the expiry of the relevant "Validity period of Genki Point” as set out in the Table or in Member Account, and any Point(s) used or redeemed will be deducted from the Member account instantly. All unused Points will be automatically forfeited upon such expiration.

15. Points cannot be sold, purchased, transferred, gifted away, assigned or otherwise to other individual or another Member, and cannot be exchangeable for cash or combined for use with Points in other Member’s account.

16. Points can be checked in the Mobile App and the Member Area. Genki Sushi’s record (including but not limited to the record of Points balance in each Member account) is conclusive and final and binding on Member.

17. For new Members admitted on or after 24 October 2022 or Membership renewed on or after 1 November 2022, the validity period of the Point(s) as set out in the Table shall apply.

18. Genki Sushi reserves the right to withhold Points if Genki Sushi suspects such purpose or Spending to be fraudulent. In such case, Genki Sushi is also entitled to suspend the Membership for assessment until further notice or terminate such Membership.

19. Genki Sushi may, at its sole determination, deduct Points from the Membership account in the following situation:- (i) Any Points suspected to be fraudulently recorded or earned by Member; (ii) Any Points recorded in error; or (iii) Any Points relating to a transaction which has been cancelled and/or refunded.

20. Genki Sushi may from time to time impose requirements and/or limitations on Member’s participation in any promotion. Therefore, Member may not be eligible to participate in all promotions. Member taking part in any promotion shall be deemed to have agreed to be bound by the applicable terms and conditions which may be imposed by Genki Sushi in relation to such promotion.

(II) Membership Upgrade, Downgrade and Renewal

21. (a) Basic Pass Members will be upgraded to Silver Pass Members when the Members have accumulated Cumulative Spending of HK$950 or above within any consecutive 62 days during the validity period of such Basic Pass Membership.

(b) Silver Pass Members will be upgraded to Premium Pass Members when the Members have accumulated Cumulative Spending of HK$16,000 or above within the validity period of such Silver Pass Membership.

(c) Premium Pass Members will be downgraded to Silver Pass Members when the Members fail to accumulate Cumulative Spending of HK$8,000 or above within the validity period of such Premium Pass Membership.

22. (a) The Membership upgrade mentioned in paragraph 21(a) and (b) above will be implemented automatically in the next working day upon the Cumulative Spending fulfilling the upgrade criteria within the applicable designated period as set out in the Table.

(b) The Membership downgrade mentioned in paragraph 21(c) above will be implemented automatically at the end of the validity period of the Premium Pass Membership if the Cumulative Spending cannot meet the renewal criteria within the applicable designated period as set out in the Table.

23. Silver Pass and Premium Pass Memberships will be renewed at the end of the applicable validity period of such Membership upon the Cumulative Spending fulfilling the applicable renewal criteria within the applicable validity period of such Membership as set out in the Table.

24. For the newly upgraded level of Membership which is in a level higher than the previous Membership level, the upgraded Membership’s validity period is valid from the commencement of the upgraded Membership until the end of the validity period of such upgraded level of Membership.

25. For renewed Membership in Premium Pass and Silver Pass levels, and/or Membership downgraded from Premium Pass to Silver Pass, the Membership validity period is valid from the commencement of such renewed/downgraded Membership until the end of the validity period of such renewed/downgraded Membership.

26. Member can login to Member’s area via Genki Sushi website or Mobile App to check the expiry date of the current Membership. In order to safeguard the rights and privileges of Members, Genki Sushi will notify Members of the Membership expiry date before expiration of Membership.

27. Membership upgrade and downgrade are automatically handled by the system, based on the amount of Cumulative Spending. Members cannot choose whether to be upgraded or downgraded.

(III) Expiry

28. Basic Pass Membership will automatically expire upon the end of the relevant Membership validity period if it fails to meet the upgrade criteria within the designated period during the applicable Membership validity period set out in the Table.

29. Silver Pass Membership will automatically expire upon the end of the relevant Membership validity period if it fails to meet to the applicable renewal criteria within the designated period as set out in the Table.

(IV) Termination

30. Member may terminate his/her Membership at any time by informing Genki Sushi in writing. All unused Points will then be forfeited on the termination of the Membership.

31. In the event of any breach of the Terms, Member’s abuse of any of the Program privileges in Genki Sushi’s sole opinion, or the use of the Member account in an unauthorized, fraudulent or otherwise unlawful manner, Genki Sushi reserves the right to terminate or suspend the Membership and/or revoke all the Points that have been earned or accumulated by the Member without notice. Genki Sushi will not be liable for any loss or damage resulting therefrom and also has the right to take action for recovery of any loss and/or damage suffered by Genki Sushi under these circumstances.

32. Genki Sushi reserves the right to terminate the Program and/or its operation at its sole discretion at any time with reasonable notice, without giving any reason therefor. All rights and/or privileges of an applicant/Member shall cease upon termination and Genki Sushi will not be liable for any loss or damages resulting therefrom.

D. Member Account and Mobile App

1. Member account stored at the Mobile App is for the sole and exclusive use by the Member. Member shall not allow or knowingly allow any other person to use the Member account (or any related information).

2. Member acknowledges that there may be a time lag in transmission of instructions, information or communication relating to the Program.

3. Member shall act in good faith, exercise reasonable care and diligence in keeping his/her Member account (and its related information).

4. Member shall be fully liable for any accidental or unauthorized disclosures of his or her Member account (and its related information) and shall bear the risks of Member account (and its related information) being used by unauthorized persons or for unauthorized purposes.

5. Upon notice or suspicion of Member account (and its related information) being disclosed to any unauthorized person or for unauthorized purposes, Member should notify Genki Sushi as soon as practicable and, until Genki Sushi’s actual receipt of such notification, Member shall remain liable for any and all use of Member account by unauthorized persons or for unauthorized purposes.

6. None of Genki Sushi or any network provider warrants or represents that the Mobile App, Member account and related information is free from virus or other destructive features which may adversely affect the Member’s devices, including its hardware, software and/or equipment.

E. Data Privacy

1. The personal data supplied by Members is required for the operation of the Membership. For details of how Genki Sushi uses the personal data in connection with your Membership, please refer to Genki Sushi’s Privacy Policy Statement (“Privacy Policy”). Failure by Members to provide or keep required data up to date may result in Genki Sushi being unable to provide Membership services and associated benefits. In such cases, Membership may be terminated.

2. All personal data is managed in accordance with the Privacy Policy. Such Privacy Policy is deemed incorporated into and form part of the Terms.

3. Members have the right to exercise their data protection rights such as request to access certain personal data held about them by Genki Sushi and correct any inaccuracies as set out in the Privacy Policy. Members can contact our customer services hotline or follow the contact method as set out in the Privacy Policy to exercise such rights.

4. Members should provide up-to-date contact details, including current email and phone number to ensure that all Program communications are being sent to the proper address. Members should notify Genki Sushi immediately of any change in such contact details. Genki Sushi shall not be liable for any potential or actual loss, claims or damages in any form incurred by the Member arising directly or indirectly from the lack of accurate and up-to-date contact details.

5. Members must ensure that safe keeping of his/her Member number and the password is not disclosed to any unauthorised parties. Genki Sushi cannot be held liable for the consequences of any unauthorised disclosure of the password by Members or unauthorised use of the password.

F. Miscellaneous

1. Genki Sushi shall not be liable to any Member for any indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with the Membership and/or the use of or the unavailability of any Membership services and/or the provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by negligence or otherwise, and whether Genki Sushi have any control over the circumstances giving rise to the claim or not.

2. Member has no right to participate in the constitution, operation or management of the Program nor any right in or any claim to any assets of Genki Sushi.

3. In the event of any dispute arising from Member account or Program, Genki Sushi’s sole decision shall be final and binding on an applicant and/or Member.

4. An applicant’s or a Member’s use of the Mobile App and/or Genki Sushi website is deemed to be an acceptance of the Terms. For the Term and Privacy Policy, please visit Genki Sushi website: members.genkisushi.com.hk or Mobile App.

5. Genki Sushi reserves the right to modify the Membership programme, Membership tier, benefits and other features including the Terms or revoke any right and/ or privilege upon reasonable notice, where possible, and Genki Sushi will not be liable for any loss or damage resulting therefrom. All changes or amendments are effective once announced on the Genki Sushi website or Mobile App. Applicant or Member should regularly check whether the Terms have been modified or right and/or privilege has been revoked via Genki Sushi website or Mobile App as an applicant’s or Member’s continued use of Genki Sushi website or Mobile App indicates the acceptance of any change to the Terms and/or revocation of right and/or privilege. In case of any dispute, the decision of Genki Sushi shall be final and conclusive.

6. The failure by Genki Sushi to exercise or enforce any rights herein contained shall not be deemed to be a waiver thereof nor shall it affect Genki Sushi’s entitlement to take any subsequent action in respect of that right or of any other right.

7. Should any provision of these Terms be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

8. These Terms and the relationship between Genki Sushi and each Member and applicant are governed by Hong Kong law. Genki Sushi and each Member and applicant submits to the non-exclusive jurisdiction of the Hong Kong courts.

9. If there is any inconsistency or conflict between the English version and Chinese version of the Terms, the English version shall prevail.

Genki Member Privileges

1. Genki Sushi shall not be liable to any Member for any indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with the Membership and/or the use of or the unavailability of any Membership services and/or the provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by negligence or otherwise, and whether Genki Sushi have any control over the circumstances giving rise to the claim or not.

2. Genki Points

(a) Only Silver Pass and Premium Pass Members are eligible to earn and use Genki Points for their dine-in, takeaway transactions at Hong Kong Genki Sushi outlets or online takeaway transactions. Exclusive of spending on third-party takeaway platforms.

(b) Based on the total net amount of the transactions, 1 Genki Point (“Point”) will be earned for every $10 spent during the valid Genki membership period. No Point will be awarded for service charge in the transactions.

(c) Premium Pass Members can earn 1.5X Points during Monday to Thursday (except for Friday, Saturday, Sunday and public holiday).

(d) The spending in cents and transaction under $10 will not be counted in calculating the Point(s) earned for any transaction. For example, if the net transaction amount is $125.50, 12 Points will be earned.

(e) Every 10 Points earned can be used as $10 in the subsequent transaction at Hong Kong Genki Sushi outlets. Points can be used in blocks of 10 Points. Points used will be deducted from the Member account instantly at the transaction.

(f) All cancelled transactions and refunds are not eligible for Points, such Points will be automatically deducted from the Member account, including the extra Points earned from specific promotions.

(g) Points are not transferable to another Member.

(h) For expiry of Points earned from specific promotions, member should refer to the "Expiry Date of Genki Points” in Member Account

3. In-app queuing

(a) Silver Pass Members and Premium Pass Members may enjoy in-app queueing service.

(b) Premium Member Express Queuing service is only available via in-app queuing. Express Queuing service is not available at queuing machines at stores.

4. Thankful Day Discount

(a) Silver Pass Members may enjoy a 20% off at any Hong Kong Genki Sushi outlets on Genki Member Thankful Day (The first Wednesday of every month, unless specified otherwise) by his/her valid Member account at the time of payment.

(b) Premium Pass Members may enjoy a 20% off at any Hong Kong Genki Sushi outlets on Genki Member Thankful Day (The first Tuesday of every month, unless specified otherwise) by his/her valid Member account at the time of payment.

(c) Please present a valid Member account at Hong Kong Genki Sushi outlets or login with a valid Member account during online takeaway ordering at the time of payment to enjoy the Thankful Day discount.

(d) This offer is only valid at Genki Sushi outlets in Hong Kong. Only applicable for dine-in, takeaway and online takeaway ordering (same-day pickup only). Third-party takeaway platform and Genki Sushi festive takeaway sets are not applicable to this offer.

(e) Additional 10% service charge applies for dine-in, which is calculated from original dine-in total amount before applying the discount.

(f) Points can be used together with the Thankful Day offer, but no Points will be awarded for the whole transaction.

(g) This offer cannot be used in conjunction with Genki Sushi coupons, e-coupons (except yuu Maxim’s voucher), cash coupons, other promotional offers, discount and purchase of any takeaway container and cutlery.

5. Birthday Discount

(a) Silver Pass and Premium Pass Members may enjoy a one-time birthday discount at any Genki Sushi outlets in Hong Kong during his/her birthday month (e.g. if the Member’s birthday is on 15 Oct, birthday month covers the period from 1-31 October) by presenting the birthday e-coupon. The birthday discount for Silver Pass Members is a 20% off discount, whereas that of Premium Pass Members is a 25% off discount.

(b) If the Membership is created on his/her birthday month, Member may enjoy the birthday offer in his/her birthday month in the following year. For example, the Member has registered in June which is also his/her birthday month, he/she may enjoy the birthday offer in June in the following year.

6. Member price menu, Secret Menu and Discount/Free dish coupon

(a) Member is required to login Member Account with Genki Sushi mobile app, use "Scanner" to scan the ordering QR code to order exclusive menu via dine-in Mobile Order. Alternatively, member may select Member Menu to order exclusive menu via online takeaway ordering platform.

(b) Member is required to login Member Account with Genki Sushi mobile app, use "Scanner" to scan the ordering QR code to order and enjoy exclusive menu discount offer via dine-in Mobile Order. Such offer requires presentation of the same Member Account used for Mobile Order and upon payment. If a different Member Account is presented upon payment or check out as Guest, no member exclusive menu discount offer will be applied. Alternatively, member may select Member Menu to order and enjoy exclusive menu discount offer via online takeaway ordering platform.

(c) Limited Time Surprise Privileges will be launched from time to time . Please refer to the latest announcement of Genki Sushi website or mobile app for details.

7. Terms and Conditions of Genki Membership Program

(a) The above privileges and offers are subject to Terms and Conditions of Genki Membership Program. For details, please refer to Genki Sushi website, Mobile App or call 2101-1161 (Monday to Sunday: 10am - 9pm).

(b) Genki Sushi Hong Kong Limited reserves the right to amend the above terms and conditions of the above privileges and offers from time to time without prior notice. In case of any disputes, the decision of Genki Sushi Hong Kong Limited shall be final.
