Online Ordering Terms and Conditions

1 General
Please read the following Terms and Conditions carefully before using the service. By using the Genki Sushi’s online takeaway ordering service (“online ordering service”)in this website provided by Genki Sushi (Hong Kong) Limited (“Genki Sushi”) for the territory of Hong Kong Special Administrative Region (“Hong Kong”), you agree that you have read these Online Ordering Terms and Conditions (“Terms and Conditions”) and that you accept and agree to be bound by them. Genki Sushi reserves the right to amend these Terms and Conditions anytime and will publish the revised version on the website.
The online ordering service is directed solely at persons accessing the website from Hong Kong.
2 Settings Requirements of online ordering service
In order to use this service, you are required to access Genki Sushi’s online ordering service through computers, mobile phones or tablets. Genki Sushi recommends the following browser settings for the best experience:
- Chrome 31/ Firefox 27/ Safari 7 or above versions
- Recommended screen resolution: 1024 x 768
- Javascript and Cookies must be turned on
3 Eligibility and Login
The online ordering service is opened to Genki Sushi members and non-members in Hong Kong. Before placing orders through the online ordering service, please read the Terms and Conditionsand Privacy Policy Statement. By using online ordering service, you are deemed to have agreed to be bound by the Terms and Conditions and Policy Statement. Genki membership is not transferable or assignable and is for the designated member’s personal use and benefit only. Proof for verification of the membership identity may be required.
3.2 Genki members are required to use the membership number or registered email address and the set password to login and place order through the online ordering service.
3.3 Non Genki members or Genki Point Card account holders can place order via the online ordering service as a guest.
3.4 Within a period of 62 days upon registration of a Genki Point Card account, spending on online ordering service (calculated by the transaction amount after discount per order) will be counted towards the cumulative spending of that Genki Point Card account.
3.5 The said time limit of 62 days starts from the day immediately after the first recorded transaction is made (excluding the date of transaction). For example, if the first recorded transaction is made on September 1, 2019, the last day of the time limit will be November 2, 2019.
3.6 Genki members, Genki Point Card account holders and non-members are responsible for all actions, transactions and/or activities being conducted on this website.
3.7 Genki Sushi has the absolute discretion to refuse the login of any person or to terminate the access right to or use of the online ordering service of or by any person for any reason whatsoever.
4 Online Takeaway Ordering
4.1 This website only provides takeaway ordering services with self pick-up. It does not provide delivery services.
4.2 Customers can place orders with pickup period not more than two weeks after the transaction is made. For pickup orders on the same day as the order is placed, customers are required to finish the ordering procedures at least 1 hour or more prior to the expected pickup time. On Member Thankful Day will need 1.5 hours in advance. For pickup period on 31st January, 1st and 9th February 2022, same day order is allowed provided that the order for at least 2 hours prior to your scheduled pickup time. For pickup period on 2nd and 3rd February 2022, same day order is allowed provided that the order for at least 2.5 hours prior to your scheduled pickup time.
4.3 To place an order via the online ordering service, the customer needs to provide an email address for receiving the order confirmation email and his/her phone number for contact purpose. If the customer is providing contact of another person, he/she is required to obtain the consent of such other persons, concurrently, the customer is also obligated to be responsible for providing such personal information.
4.4 Order made on this website is subject to acceptance and confirmation by Genki Sushi. Once an order is confirmed, the order can neither be cancelled nor altered.
4.5 Separate orders and payment are required if takeaway orders are to be collected at different time, on different dates or at different stores.
5 Product information and pricing
5.1 Genki Sushi reserves the right to update the price and/or product details at any time. All the product details and/or price are based on the information displayed at the online ordering service when Genki Sushi confirms the order.
5.2 Genki Sushi shall use its reasonable effort to ensure products displayed on the website are in stock. If any product is out of stock, Genki Sushi reserves the right to offer alternative product(s) of similar pricing and category as replacement.
5.3 The prices posted on this website are applicable to online ordering only. Some products may be priced differently at Genki Sushi store(s).
5.4 Genki Sushi may at its absolute discretion from time to time decline any order, set credit limit(s) against any person, transaction or credit card and/or restrict purchase quota(s).
5.5 Product information, colour, pricing and image(s) are for reference only.
6 Use and gain of Genki Points (applicable to Genki Sushi members)
6.1 The use of Genki Points is governed by the Terms and Conditions of Genki Membership Program. Please refer to http://members.genkisushi.com.hk for details.
6.2 After deduction of Genki Points, the remaining balance of the same online order must be settled by a valid VISA card or MasterCard via the online ordering service.
6.3 Genki Sushi member's Birthday Offer does not apply to any online ordering service.
7 Payment
7.1 Payment for online takeaway order, or remaining balance after deducting the amount of Genki Points used (if applicable), must be settled by a valid VISA card or MasterCard via the online ordering service.
7.2 All prices are listed in Hong Kong Dollars. In no event that Genki Sushi shall be responsible for any cost charged incurred to the customer due to any bank, payment method and/or currency.
7.3 The system of online ordering service has applied Secure Socket Layer (SSL) technology. All personal information including customer’s credit card number, name, email address and phone number will undergo encryption before transmission through internet to protect the information from being accessed by unauthorized third-party during transmission.
7.4 Genki Sushi reserves the right to modify payment terms for any order without prior notice.
8 Order Pickup
8.1 Under general circumstances, the order pickup time is between 11:30am and 9:30pm every day which may change due to operational status of the particular store(s). When the selected store becomes unavailable for pickup at certain dates and time slots, Genki Sushi will contact the customer to arrange alternative pickup time and/or stores.
8.2 Discounts will be applied to orders placed on Member Thankful Day with self-pickup on the same day of the Member Thankful Day. Upon completion of the order, any change of order will not be entertained. For orders placed on Member Thankful Day with self-pickup on another day, discount will not be applied even if pickup dates are changed to the same day of the Member Thankful Day after completion of transaction.
8.3 Genki Sushi shall use its reasonable effort to ensure orders to be completed within the selected pickup time assigned by the customer, but pickup time in particular store(s) may be reasonably delayed due to operational circumstances.
8.4 If an order is not being picked up within 1 hour from the selected pickup time specified on the order, the order will be deemed cancelled / void and no refund will be made. Notwithstanding the foregoing, the 1-hour limit will be reduced due to the business hours of the relevant store(s).
8.5 During pickup, customers must show the valid order barcode or order confirmation to the staff for verification. Each order barcode can be used for pickup once only. Pickup records kept by Genki Sushi shall be deemed conclusive.
8.6 Customers should keep properly the confirmation email and order barcode. Anyone showing the staff of the relevant store with a valid order confirmation or barcode will be deemed as an authorized representative for order pickup.
9 Refund and Cancellation
9.1 Upon confirmation of the order, neither the order can be cancelled, nor the item(s) can be altered by the customer.
9.2 All items sold are non-refundable, non-returnable and non-exchangeable after payment of such order has been completed.
10 Others
10.1 In case of any dispute, the decision of Genki Sushi (Hong Kong) Limited shall be final.
10.2 If there are discrepancies between the English and Chinese versions of the terms and conditions, the English version of the terms and conditions shall prevail.
